The India foreign asset disclosure scheme just grew sharper teeth, with tax officials now contacting residents who quietly bought property in the UAE. India’s Income Tax Department says it has started reaching out to selected taxpayers with residential or commercial real estate in the Emirates that never showed up on their returns.
NEW DELHI, India – 28 October 2026
The push follows a high-level review on 23 October, according to reports from ANI, Business Standard and Business Today. Around 1,100 people have filed declarations so far under the Foreign Assets of Small Taxpayers Disclosure Scheme, 2026 (FAST-DS). The window shuts on 31 December 2026, and there’s no sign of an extension.
Officials also confirmed that taxpayers can now log in to the e-filing portal and download the foreign account data other countries have sent about them under the Common Reporting Standard and FATCA. The department is showing its hand, and it’s a strong one. For anyone weighing whether India should still be their tax home at all, serious tax residency planning belongs on the agenda now.

What Did India’s Tax Department Announce This Week?
India’s Income Tax Department said on 26 October that it has begun contacting selected taxpayers who own undisclosed residential or commercial property in the UAE, nudging them toward FAST-DS before its 31 December 2026 deadline. It also confirmed roughly 1,100 declarations so far and opened portal access to CRS and FATCA data for 2022 to 2024.
The Central Board of Direct Taxes also plans outreach to employers, universities and industry groups, and it’s set up regional committees to field questions.
Read the fine print on the data, too. Business Today and ANI both report that the portal shows only CRS and FATCA information, while the department holds other data it won’t display. So an empty screen doesn’t mean a clean file. Assume they know more than you can see.
How Does the India Foreign Asset Disclosure Scheme Work?
The India foreign asset disclosure scheme has two tracks. Undisclosed foreign assets or income up to Rs 1 crore are settled at 30% tax on the 31 March 2026 value plus an equal penalty. Assets up to Rs 5 crore bought with already-taxed or non-resident income can be regularised for a flat Rs 1 lakh fee.
Parliament created FAST-DS in Chapter IV of the Finance Act, 2026, according to the Income Tax Department’s official FAST-DS user manual. Filing opened on 16 August 2026.
| Feature | Track 1: Undisclosed income or assets | Track 2: Unreported but taxed assets |
|---|---|---|
| Ceiling (aggregate) | Up to Rs 1 crore | Up to Rs 5 crore |
| What you pay | 30% tax plus equal penalty (60% in total) | Flat Rs 1 lakh fee |
| Valuation date | 31 March 2026, fair market value | 31 March 2026 |
| Typical case | Income or assets never taxed in India | Assets from taxed income left off Schedule FA |
| Penalty avoided | Black Money Act assessment and prosecution | Rs 10 lakh per year non-reporting penalty |
| Filing deadline | 31 December 2026 | 31 December 2026 |
According to KPMG’s analysis of the FAST-DS Rules, eligibility centres on people who were resident and ordinarily resident in India in the relevant year, even if they’ve since left. KPMG adds that proceeds of crime under active money-laundering proceedings are excluded, as are cases where a Black Money Act assessment is already complete.
Why Are UAE Property Owners in the Spotlight?
UAE property owners are in the spotlight because the Emirates is one of the most popular overseas property markets for Indian residents, and Indian tax residents owe tax on worldwide income and must list foreign assets on Schedule FA. Officials haven’t said where the UAE property data came from.
I’ve watched this play out before. We regularly speak with Indian families who bought a Dubai apartment off-plan years ago and assumed it sat outside India’s view because no foreign bank account was involved. That’s the trap. Rental income usually lands in a local account, and that account is exactly what CRS reports.

What Happens If You Miss the FAST-DS Deadline?
Miss the FAST-DS deadline of 31 December 2026 and the immunity disappears. Undisclosed foreign assets then fall back under the Black Money Act, 2015, which carries a Rs 10 lakh penalty for each year of non-reporting, plus exposure to assessment and possible prosecution. The India foreign asset disclosure scheme is a one-time window.
Read that number twice. Ten lakh rupees a year adds up fast on a flat you’ve held since 2019, against a one-off Rs 1 lakh fee.
Timing matters after filing too. KPMG reports you’ll generally have two months to pay once the order arrives, plus two more at 1% monthly interest. Miss that and the declaration lapses.
Is the India Foreign Asset Disclosure Scheme Worth Using?
For most residents holding undeclared UAE property, the India foreign asset disclosure scheme is cheaper than the alternative. A Rs 1 lakh fee or a 60% levy on a capped amount beats years of Rs 10 lakh penalties and possible prosecution once CRS data links an account to your PAN.
On paper it works, in practice it doesn’t for everyone. Anyone above the Rs 1 crore or Rs 5 crore ceilings can’t use it. Those cases need an Indian tax lawyer first. Our guide to CRS reporting for trusts explains why simply moving assets into a trust won’t hide them.
