If you want to know how to renounce Indian citizenship, the first fact is that you’ve probably already lost it: India ends your citizenship automatically the day you voluntarily take another country’s, and the government treats the date your new passport was issued as proof of when that happened. What’s left is paperwork. You surrender your Indian passport, obtain a surrender (renunciation) certificate from the Indian mission where you live and, if you naturalised on or after 1 June 2010, file a Form XXII declaration through the Ministry of Home Affairs portal.
The process is cheap by government standards, usually under £100 or €100 plus outsourcing fees. Getting it wrong is what costs money. New Delhi fines people for travelling on a passport it says they no longer had any right to hold, and you can’t get an OCI card until the certificate is in your hand.

Do You Have to Renounce Indian Citizenship?
Yes, if you take another nationality voluntarily. Section 9(1) of the Citizenship Act, 1955 says an Indian who acquires foreign citizenship by naturalisation or registration ceases to be a citizen “upon such acquisition”. Schedule III of the Citizenship Rules, 2009 adds that obtaining a foreign passport is conclusive proof you’d acquired that citizenship before the passport’s issue date.
Read that second rule carefully. India doesn’t wait for you to tell it anything. Your Indian citizenship ends on its own, and the burden of proving otherwise sits with you under paragraph 1 of the same Schedule. The trigger differs from the absence rules in our guide to countries that cancel your citizenship automatically: India switches citizenship off when you naturalise somewhere else, however long you’ve lived in India.
Indian clients finishing a Caribbean citizenship application nearly always ask us the same question: can they keep the old passport in a drawer, just in case? They can’t, legally. Holding it after the switch is an offence under Section 12(1A) of the Passports Act, 1967, and the Consulate General in Edinburgh says so on its own guidance page.
How to Renounce Indian Citizenship: The Two Routes
There are two routes, and which one you use depends on whether you already hold the other passport. If you do, you surrender your Indian passport and get a surrender certificate, with a Form XXII declaration on top for adults naturalised on or after 1 June 2010. If you don’t, you make a Section 8 declaration and wait for the Ministry of Home Affairs to register it.
| Your situation | Legal basis | What you file | Typical processing |
|---|---|---|---|
| Adult, took foreign citizenship on or after 1 June 2010 | Section 9 (automatic loss) | Passport surrender application plus Form XXII on the MHA portal | 15 working days (San Francisco) to 30+ days (Milan) |
| Adult or minor, took foreign citizenship before 1 June 2010 | Section 9 | Surrender certificate only | Same as above |
| Minor who took foreign citizenship on or after 1 June 2010 | Section 9 | Surrender certificate only, no MHA declaration | Same as above |
| Still only Indian, new country wants you to give up Indian nationality first | Section 8 (renunciation by declaration) | Form XXII on indiancitizenshiponline.nic.in, signed before a consular officer | 10 to 12 weeks minimum (Munich), MHA clearance needed |
Missions don’t all read the rules the same way. Edinburgh has adults who naturalised after June 2010 file both the surrender and a Form XXII. Munich says people who already hold another citizenship aren’t eligible to renounce at all, because Section 9 already did it for them. Check the page of the mission covering your address before you pay anything.
How to Renounce Indian Citizenship Step by Step
For most readers (an adult who already holds the new passport), the process takes five steps and roughly one to six weeks once the consulate has a complete file. The order matters, because each step generates a reference number the next one asks for.
Step 1: Wait for the foreign passport. A naturalisation certificate isn’t enough. San Francisco won’t accept an application without a copy of the new passport, so newly naturalised citizens have to wait for it to arrive.
Step 2: File Form XXII on the MHA portal. Adults naturalised on or after 1 June 2010 register the declaration at indiancitizenshiponline.nic.in/Renounce. Edinburgh warns that once you submit, you can’t modify it, so match every detail to your Indian passport.
Step 3: Complete the surrender application. On the Passport Seva portal, choose “surrender of Indian passport” and note the ARN. In the US you then go back to the VFS site to pay and schedule the submission. Filling in the online form alone doesn’t complete anything.
Step 4: Submit the documents. Edinburgh’s list is typical: copy of the foreign passport, copy of the naturalisation certificate, the original Indian passport, copies of its used pages and one photograph. Some missions ask for proof of address too.
Step 5: Collect the certificate and guard it. San Francisco says it doesn’t keep copies of the renunciation certificates it issues. Lose yours and you reapply from scratch.
Before you hand the old passport over, scan every page with a visa or stamp on it. You’ll want that record if a foreign immigration officer ever asks about past travel.
Renunciation of Indian Citizenship Fees by Country
Renunciation of Indian citizenship fees are set in rupees and charged in local currency, so they differ slightly by mission. The base government charge for registering a renunciation declaration abroad is Rs 7,000 under Schedule IV of the Citizenship Rules, and missions add a surrender fee, the Indian Community Welfare Fund levy and the outsourcing agent’s service charge.
| Mission | Item | Fee (as of November 2026) |
|---|---|---|
| UK (CGI Edinburgh) | Surrender certificate | £20 |
| UK (CGI Edinburgh) | Form XXII renunciation (INR 7,000 registration + INR 1,000 oath) | INR 8,000 (£79) |
| Italy (CGI Milan) | Renunciation and surrender, general | €94 |
| Italy (CGI Milan) | Foreign nationality obtained before 1 June 2010 | €114 |
| Germany (CGI Munich) | Section 8 renunciation, including ICWF | €90 |
| USA (Embassy, Washington) | Passport surrender after a Section 8 certificate | US$25 + US$3 ICWF + VFS fee |
Edinburgh puts the UK total at £99 before the welfare levy and VFS charges. Budget a little more than the headline fee wherever you are, because the agent’s charges are non-refundable even if your file is rejected.
Penalty for Not Surrendering Indian Passport
The penalty for not surrendering an Indian passport is zero if you never used it and surrender within three years of getting your foreign passport. Use it to travel and you pay Rs 10,000 per journey, capped at Rs 50,000. Renewing it after the switch costs Rs 25,000 per renewal on top, according to the Embassy of India in Bern (checked November 2026).
| What you did after taking foreign nationality | Penalty |
|---|---|
| Kept the passport up to 3 years, never travelled on it | None |
| Kept it up to 3 years, travelled on it | Rs 10,000 per trip, maximum Rs 50,000 |
| Kept it more than 3 years and travelled on it | Rs 10,000 for retention plus Rs 10,000 per trip (trips capped at Rs 50,000) |
| Renewed or reissued it and travelled on it | Rs 25,000 per renewal plus Rs 10,000 per trip (trips capped at Rs 50,000) |
This is where people get burned. The criminal provision behind the fines, Section 12(1A) of the Passports Act, carries one to five years in prison and a fine of Rs 10,000 to Rs 50,000, so the administrative penalty is the cheap outcome. Clients who naturalised years ago and never surrendered are common in our files. The fix is usually a penalty and a stack of paperwork, and it’s cheaper the sooner you do it.
Minors, Lost Passports and Other Edge Cases
Children. Minors who took foreign citizenship on or after 1 June 2010 only need the surrender certificate, with no MHA declaration. If a parent renounces under Section 8, the parent’s minor children lose Indian citizenship too, though Section 8(2) lets each child resume it by declaration within one year of turning 18. The Citizenship (Amendment) Rules, 2026, notified on 30 April 2026, also state that a minor can’t hold another country’s passport while holding an Indian one.
Lost Indian passport. The San Francisco consulate lets you apply under the “lost passport” category, entering the number as LOST or 00000. Without a copy of the old passport, you provide two of: voter ID, SSC certificate or higher, birth certificate, or proof of a parent’s Indian origin. The consular officer’s decision on those documents is final.
Applying during a war. Both Section 8 and Section 9 contain a proviso that lets the central government hold back the effect of a renunciation or acquisition while India is at war. It’s never been a practical issue for our clients, but it’s in the statute.
OCI After Renunciation: What You Keep
OCI after renunciation gives you a lifelong multiple-entry visa for India and parity with non-resident Indians in most economic and financial matters, except buying agricultural or plantation property. You can’t vote or normally hold a government job. The San Francisco consulate’s OCI guidance says a renunciation certificate is compulsory before you apply.
Two groups are shut out. Anyone who served in a foreign military can’t get OCI, and Section 7A excludes anyone who, or whose parent, grandparent or great-grandparent, is or was a citizen of Pakistan or Bangladesh. Since the 2026 amendment, OCI applications are filed electronically and registration can be issued as an e-OCI.
We tell clients to finish the surrender before they start the OCI form, since it asks for the certificate. Doing them in the wrong order adds weeks.
What You Gain: The Indian Passport Against the Usual Replacements
The passport you’re swapping in is a bigger upgrade than most people realise. On Liberty Mundo’s Passport Freedom Index, which scores 198 passports on mobility, financial freedom, citizenship security, state protection and personal liberty, India ranks 153rd with a Freedom Score of 46.6 and 56 visa-free destinations.
| Passport | Freedom Index rank | Freedom Score | Visa-free destinations |
|---|---|---|---|
| India | 153 | 46.6 | 56 |
| Germany | 19 | 85.0 | 186 |
| United Kingdom | 35 | 82.1 | 183 |
| Canada | 44 | 79.7 | 181 |
| Australia | 50 | 77.7 | 182 |
| Singapore | 54 | 76.2 | 192 |
| United States | 65 | 71.8 | 179 |
| United Arab Emirates | 70 | 69.5 | 187 |
Every destination on that list more than triples the visa-free count. India forces the choice because it bans dual nationality outright, which is why so many wealthy Indian families look at citizenship by investment and then keep their ties to India through OCI. The trade-offs of holding two nationalities in countries that do allow it are covered in our guide to dual citizenship pros and cons.
Can You Get Indian Citizenship Back?
Yes, but slowly. Section 5(1)(f) of the Citizenship Act lets an adult who was a citizen of independent India, or whose parent was, register as a citizen again after being ordinarily resident in India for the 12 months before applying.
OCI holders have a second route under Section 5(1)(g) after five years of OCI registration plus 12 months’ residence. The government can relax the 12 months by up to 30 days of breaks in special circumstances. Bottom line: renunciation is reversible on paper, and very few people who’ve upgraded their passport ever bother.
Mistakes We See With Indian Renunciation
- Travelling on the Indian passport “one last time”. Every trip after the foreign passport’s issue date is a Rs 10,000 penalty.
- Renewing the Indian passport after naturalising. That’s Rs 25,000 per renewal and the most expensive line in the penalty table.
- Typos on Form XXII. You can’t edit it after submission, and a mismatch with your passport can get it rejected.
- Applying for OCI first. The OCI application needs the renunciation certificate, so it stalls.
- Assuming another mission’s rules apply. Edinburgh, Munich and San Francisco each word the requirements differently. Your local mission’s page is the one that counts.
If you’re still planning the move and haven’t picked the new passport yet, our second citizenship programs page compares the routes we handle, and our guide on whether you can renounce citizenship without having another citizenship explains why India, like most countries, won’t let you go stateless.
